What is mediation?
Conflicts can put relationships on edge, paralyze businesses, and cause legal nightmares. . Mediation offers a constructive way out of conflicts, in which the parties try to reach a solution together with the help of a neutral third party: the mediator. the mediator is in charge of the process, but the parties remain in charge of the conflict at all times.

Characteristics of mediation
- Volunteering is central: parties choose to start a process, and are free to decide to stop this process (early).
- The process is confidential: everything that is discussed during the process falls under confidentiality. One cannot subsequently invoke matters discussed during the mediation in another context. Confidentiality is ensured by the signing of the bemiddelingsprotocol.De
- mediator is neutral, impartial and independent. This helps to improve communication, clarifies the points of view and stimulates the parties to come to a solution themselves. The mediator does not give any judgment or advice.
- With a view to a solution, there is room for creativity and out-of-the-box thinking. As long as the solution of the parties does not contradict public policy or rules of mandatory law, they have complete freedom.
- The parties remain in control of the conflict. No solution is imposed on them.
Eligible conflicts
- Family Matters: below are all conflicts within the family context. Think of divorces, inheritance issues, conflicts within newly-made families…
- Civil matters: This includes all conflicts between persons. Think of neighbor disputes, landlord-tenant disputes, conflicts between co-owners…
- Commercial matters: this includes all conflicts in which a commercial relationship is present. Think of conflicts between partners/ directors, conflicts between supplier and customer, conflicts between companies…
